Our store is powered by Shopify Inc., which provides the e-commerce platform enabling us to sell products worldwide. Certain Shopify terms and policies may apply in addition to these Terms.

Being Shipped, Inc. is an authorized reseller of all brands and products offered on our website. We are not the manufacturer, distributor of record, or agent of the brands we sell. However, manufacturers may change specifications, firmware, or packaging without prior notice. Product availability may vary, and we cannot guarantee that all items displayed online will be in stock at all times. We are not responsible for typographical, pricing, or listing errors, which may be corrected without prior notice.
5. Orders, Acceptance, and Pricing
All orders placed through our website are offers to purchase, subject to our acceptance and verification. Receipt of an order confirmation or payment authorization does not constitute acceptance. Acceptance occurs only when we dispatch the product(s). We reserve the right to reject or cancel any order for any lawful reason, including stock unavailability, payment issues, suspected fraud, or system error. If your order is cancelled after payment, we will refund the amount charged to your original payment method.
We may correct pricing or typographical errors and update information at any time without notice. Prices are subject to change without prior notice.
6. Prices, Taxes, and Duties

Unless prohibited by applicable consumer law, title and risk of loss transfer to you when the products are delivered to the carrier. You must inspect all deliveries promptly and report any damage or shortage to both the carrier and Being Shipped within the timeframe specified in our Shipping Policy.

We ship products to customers worldwide. You are responsible for ensuring that import and use of the products in your country comply with local laws. Customs duties, taxes, and import fees are your responsibility. Customs delays are beyond our control. We are not liable for any costs, seizures, or penalties arising from customs or regulatory issues outside the United States.
10. Returns and Refunds
Returns and refunds are handled according to our Returns Policy, which forms part of these Terms. Returned products must be in original condition with all accessories, manuals, and packaging. Returns that do not meet these conditions may be refused or subject to restocking fees as described in our Returns Policy.

All warranties applicable to the products we sell are provided directly by the respective manufacturers and are subject to their specific terms and conditions. Warranty claims, including repairs, replacements, or exchanges, must be made directly with the manufacturer. Being Shipped, Inc. is not responsible for the manufacturer’s evaluation, coverage determination, or turnaround time. Manufacturer warranties typically exclude damage caused by misuse, improper installation, modification, unauthorized repair, or liquid contact. We recommend reviewing the manufacturer’s warranty before purchase.
12. Promotions, Coupons, and Gift Cards
Promotions, discount codes, and gift cards are subject to their stated terms. They are non-transferable, have no cash value, and may not be combined unless expressly stated. We may modify or discontinue promotions at any time without prior notice.

EXCEPT AS EXPRESSLY STATED BY THE MANUFACTURER OR REQUIRED BY LAW, THE PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. BEING SHIPPED DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEING SHIPPED, INC. AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE PRODUCTS OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT.
19. Indemnification
You agree to indemnify, defend, and hold harmless Being Shipped, Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses (including attorneys’ fees) arising out of your breach of these Terms, misuse of the Services, or violation of applicable law.
20. Force Majeure
We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, weather events, natural disasters, labor disputes, supply chain disruptions, carrier failures, governmental actions, public health emergencies, or telecommunications outages.
21. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or related to them shall be governed by the laws of the State of Florida, U.S.A., without regard to its conflict of law principles. However, if you are a consumer residing outside the United States, you may also have mandatory rights under the consumer protection laws of your country of residence, which will not be overridden by this clause.
Binding Arbitration and Class Action Waiver: Except for individual claims in small claims court or claims seeking injunctive relief for intellectual property, any dispute shall be resolved exclusively by final and binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION. The arbitrator may not consolidate the claims of more than one individual.
You may opt out of this arbitration clause by sending written notice to support@beingshipped.com within thirty (30) days of your first acceptance of these Terms. Exclusive venue for any non-arbitrable matters shall be the state and federal courts located in Broward County, Florida, U.S.A.
22. Severability and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force. These Terms, together with our Privacy Policy, Returns Policy, and Shipping Policy, constitute the entire agreement between you and Being Shipped, Inc. regarding the Services and supersede all prior agreements or communications.
